Welcome to PromptPool. These Terms and Conditions ("Terms") govern your access to and use of the PromptPool website (promptpool.dev), services, and any related applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, accessing the website, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years of age to use the Service. By using PromptPool, you represent and warrant that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian.

3. Account Registration

Some features of the Service may require you to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized access to or use of your account
• Accept responsibility for all activities that occur under your account

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service to violate any applicable local, state, national, or international law
• Attempt to interfere with or disrupt the Service, servers, or networks connected to the Service
• Scrape, crawl, or use automated means to access the Service without our prior written consent
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit any harmful, threatening, abusive, or otherwise objectionable content
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

5. Intellectual Property

The PromptPool platform, including its design, code, branding, logos, and original content, is owned by PromptPool and protected by intellectual property laws. The prompt library is released under the MIT License, which permits use, modification, and distribution subject to the terms of that license.

User-submitted prompts remain the intellectual property of their respective creators. By submitting a prompt to PromptPool, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and make available your submission through the Service.

6. Subscriptions and Payments

Certain features of the Service are available through paid subscription plans. By subscribing to a paid plan, you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected
• All fees are non-refundable unless otherwise stated or required by law
• We reserve the right to change subscription pricing with at least 30 days' notice
• Your subscription will automatically renew unless you cancel before the end of the current billing period
• You are responsible for providing accurate and current payment information

7. Free Tier

PromptPool offers a free tier with limited access to prompts and features. The free tier is provided "as is" without guarantees of uptime, availability, or feature completeness. We reserve the right to modify or discontinue the free tier at any time.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. We make no guarantees regarding the accuracy, reliability, or quality of any prompts, outputs, or content available through the Service.

9. Limitation of Liability

To the fullest extent permitted by applicable law, PromptPool and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

In no event shall our total aggregate liability exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless PromptPool and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated "Last updated" date. By continuing to use the Service after any changes become effective, you agree to be bound by the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
